1. Acceptance of Terms

By creating an account or using TradeMind AI ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. No Financial Advice

TradeMind AI is an educational and informational tool only. Nothing on this Service constitutes financial advice, investment advice, trading advice, or any other type of advice. TradeMind AI is not a licensed financial adviser, broker-dealer, or investment company under any jurisdiction including the Australian Corporations Act 2001, the US Investment Advisers Act, or the UK Financial Services and Markets Act 2000. You must not rely on any AI-generated signal, analysis, or content as the basis for any investment decision. Always consult a licensed financial professional before making investment decisions. Trading financial instruments carries significant risk of loss.

3. No Guarantee of Results

Past performance of AI signals does not guarantee future results. Win rates, R-multiples, and all performance statistics are historical and may not be representative of future performance. You may lose money trading based on signals or analysis provided by this Service.

4. Eligibility

You must be at least 18 years old to use this Service. By registering, you confirm you are of legal age in your jurisdiction to access financial information services.

5. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at support@trademindai.com if you suspect unauthorised access.

6. Acceptable Use

You agree not to: • Use the Service for any unlawful purpose or in violation of any applicable laws. • Attempt to reverse-engineer, scrape, or copy the Service at scale. • Share your account or API access with others. • Use the Service to generate, distribute, or act on information that constitutes regulated financial advice in your jurisdiction without appropriate licensing. • Misrepresent AI-generated signals as your own independent research.

7. Simulated Auto-Trade Feature

The Auto-Trade feature is a paper-trading simulation only. It does not execute real trades, connect to any brokerage, or involve real money. All dollar amounts shown in Auto-Trade are simulated figures for educational purposes. Do not mistake simulated performance for real investment returns.

8. Subscriptions and Billing

Pro subscriptions are billed monthly or annually via Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods except where required by law. We reserve the right to change pricing with 30 days' notice.

9. Intellectual Property

All content, AI models, signal data, and software on this Service are owned by TradeMind AI or its licensors. You are granted a limited, non-exclusive licence to use the Service for personal, non-commercial purposes.

10. Limitation of Liability

To the maximum extent permitted by law, TradeMind AI and its affiliates, officers, and employees shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Service or from any investment decision made in reliance on it. In jurisdictions that do not allow limitation of liability for certain damages, our liability is limited to the maximum extent permitted by law. Australian Consumer Law rights are not excluded.

11. Indemnification

You agree to indemnify and hold TradeMind AI harmless from any claims, losses, or expenses (including legal fees) arising from your violation of these Terms or your use of the Service.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time from account settings.

13. Governing Law

These Terms are governed by the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Australia. For users in other jurisdictions, you may also have rights under your local consumer protection laws.

14. Changes to Terms

We may update these Terms at any time. Material changes will be notified by email to registered users. Continued use of the Service after changes constitutes acceptance.
